Terms of Service

Last updated: 26 July 2026

These Terms of Service (“Terms”) apply to your use of defiantonesclothing.com and purchases from Defiant Ones Clothing (“Defiant Ones Clothing”, “we”, “us” or “our”). By using the website or placing an order, you agree to these Terms and the policies linked on the website.

1. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded or limited.

2. Eligibility and lawful use

You must have legal capacity to enter into a purchase or have the permission of a parent or guardian. You must not use the website for unlawful, fraudulent, abusive or unauthorised purposes, interfere with its security or operation, introduce malicious code, scrape protected content, or infringe the rights of another person.

3. Products and product information

We aim to describe and display products accurately. Screen settings, lighting, manufacturing methods and reasonable production variation may cause colours, placement or dimensions to appear slightly different. These reasonable variations do not limit any rights you have where a product is materially different from its description or otherwise fails a consumer guarantee.

Products may be produced to order, offered in limited quantities or discontinued without notice. Availability is not guaranteed until we accept the order.

4. Prices, currency and taxes

Unless stated otherwise, prices displayed for Australian customers are in Australian dollars (AUD). Applicable taxes and shipping charges are shown at or before checkout. Prices and promotions may change before an order is placed.

If a price, discount, product detail or availability status is clearly incorrect because of a genuine system or human error, we may contact you to correct the order or cancel the affected item. If we cancel an item after payment, we will refund the amount paid for that item and any related charge that must be refunded by law.

5. Orders and acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges that we received your order but does not necessarily mean the order has been accepted. We may reject or cancel an order for a legitimate reason, including unavailable stock, inability to fulfil the destination, suspected fraud, payment failure, an obvious pricing error or breach of these Terms.

If we cancel an order after taking payment, we will provide a refund to the original payment method. We will not refuse service for a reason prohibited by law.

6. Payment

You authorise us and our payment providers to charge the amount shown at checkout. You must provide accurate billing and contact information and be authorised to use the selected payment method. Payment services may be subject to the provider’s terms and fraud checks.

7. Production, shipping and delivery

Processing and delivery estimates are set out in our Shipping Policy. They are estimates unless we expressly guarantee a date. Some products may be made and dispatched by third-party fulfilment partners and may arrive in separate parcels.

You are responsible for providing an accurate delivery address. Contact us immediately about any error; changes may not be possible after production or dispatch begins.

8. Returns, refunds and faulty goods

Returns and voluntary change-of-mind requests are governed by our Refund Policy. That policy operates in addition to, and does not replace, rights under Australian Consumer Law. Where goods fail a consumer guarantee, the remedy available will depend on the nature of the failure and applicable law.

9. Promotions and discount codes

Promotions and discount codes may be subject to stated eligibility, dates, minimum spend, product exclusions and usage limits. Unless stated otherwise, codes cannot be exchanged for cash, applied retrospectively or combined. We may correct or withdraw a promotion affected by an obvious error, fraud or misuse, subject to applicable law.

10. Accounts and account security

If you create an account, you are responsible for protecting your login details and for activity conducted through your account. You must provide accurate information and notify us promptly if you suspect unauthorised access. We may suspend or restrict an account where reasonably necessary to protect the store, customers or other users, or to investigate suspected misuse.

11. Intellectual property and user content

Branding, designs, artwork, product names, images, text, graphics and website content are owned by or licensed to Defiant Ones Clothing. They may not be commercially copied, modified or distributed without written permission. Content submitted in reviews or feedback must be lawful and owned or authorised by the submitter.

12. Third-party services and website availability

The store uses third-party services including Shopify, payment, fulfilment and delivery providers. Those providers may have separate terms. We take reasonable steps to operate the website but do not guarantee uninterrupted or error-free access.

13. Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable and did not result from our breach, negligence or failure to comply with a non-excludable obligation. This limitation does not apply where liability cannot legally be excluded or limited.

14. Privacy

Personal information is handled as described in our Privacy Policy.

15. Changes to these Terms

We may update these Terms prospectively by publishing a revised version. Existing rights under accepted orders are not retrospectively removed.

16. Governing law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia, subject to mandatory rights available elsewhere.
